Interpretation
The words of which the initial letter is capitalized have meanings defined under the following conditions.
The following definitions shall have the same meaning regardless of whether they appear in singular or plural.
Definitions
For the purposes of these Terms and Conditions:
- Affiliate means an entity that controls, is controlled by, or is under common control with a party.
- Country refers to Maharashtra, India.
- Company refers to SHIVTIRTH ASSOCIATES PRIVATE LIMITED, Umri (Dam) Saoner, Nagpur.
- Device means any device that can access the Service such as a computer, cellphone, or digital tablet.
- Service refers to the Website.
- Terms and Conditions mean this agreement that governs your use of the Service.
- Third-party Social Media Service refers to any external content or platform used through the Service.
- Website refers to Shivtirth Park, accessible from
https://shivtirth.com.
- You means the individual accessing or using the Service, or the company, or other legal entity represented by that individual.
Acknowledgment
These Terms govern your use of this Service and form the agreement between you and the Company.
By accessing or using the Service, you agree to be bound by these Terms and Conditions.
If you disagree with any part, you may not access the Service.
Your use of the Service is also subject to our Privacy Policy,
which describes how we handle your personal information.
General Park Terms and Visitor Rules
- Customers are not permitted to use the rides without proper swimming costumes. Swimming costumes are available on rent.
- Lockers are available on rent.
- Any kinds of medical ailments and conditions need to be declared before entering the park.
- Customers are advised not to wear jewellery, sarees, or dupattas for safety reasons.
- The price and other terms and conditions can be changed by the management without prior notice.
- Costume is available on rent.
- Rights of admissions are reserved with the management.
- Management will not be responsible for the loss or damage to any article while visiting any of the attractions.
Ticketing and Payment Policy
- Shivtirth Water Park accepts Visa, MasterCard, Debit Cards, and Net Banking for transactions made online through the website. Other payment methods may be added from time to time.
- It is mandatory to carry the email/SMS confirmation of the e-ticket to the ticket counters to avail entry to the park. Online bookings will be verified at the Special Ticket Counter and, after verification, actual tickets will be allocated to the guests. There is no refund for online bookings.
- Guests should produce valid Indian Government ID during check-in (Aadhar / PAN / Driving License / Voter ID / Passport).
- Before purchasing tickets, carefully review your booking details. The Water Park does not refund or adjust the amount against any other event or ticket once purchased.
- Some orders will be processed only after billing information has been verified. In case of incorrect billing details, processing may be delayed. If we cannot contact you, your order may be cancelled and tickets reissued to another customer.
- The Water Park reserves the right to charge listing or transaction fees for certain listings or completed transactions and may alter such fees without prior notice.
- Children with a height of 3 feet and above will require a separate ticket. No ticket is required for children below 90 centimeters. The Water Park may change the height criteria at any time without notice.
- The Water Park does not have any exchange or refund policy and prohibits exchanges or refunds after a ticket has been purchased or for lost, stolen, damaged, or destroyed tickets.
- Email confirmation: Your booking confirmation will be sent via email and must be shown at the counter to receive physical tickets.
- SMS confirmation: Your booking confirmation will be sent via SMS. The SMS must be shown at the ticket counter to collect physical tickets.
- Validity: Bookings are valid only for the date selected during the online transaction.
- Offer tickets purchased are valid for same-day visits only.
- Cancellation Policy: Tickets once booked cannot be exchanged, cancelled, or refunded.
Offers and Promotions
- Promo codes may have a specific start and end date.
- Shivtirth Water Park reserves the right to modify or cancel offers at any time.
- Offers may not be combined with other promotions. Each promo code applies only to qualifying items.
- Offers are non-transferable and may not be resold. Promo code discounts are not applicable on Senior Citizen Tickets.
- Senior Citizen Tickets must be booked separately without applying promo codes.
- If you violate any offer terms, the offer will become invalid.
Termination and Liability
We may suspend or terminate your access at any time without prior notice if you breach these Terms.
Upon termination, your right to use the Service will cease immediately. The Company will not be responsible
for any losses arising from such termination.
Limitation of Liability
To the maximum extent permitted by law, Shivtirth Water Park and its suppliers shall not be liable
for any indirect, incidental, or consequential damages.
Our total liability shall not exceed the amount paid by you for the Service.
Dispute Resolution
If you have any dispute or concern, you agree to first attempt resolution informally by contacting us directly.
Governing Law
These Terms are governed by the laws of India, excluding conflict of law principles.
